Notwane Lose With Costs

| June 11, 2015

Justice Modiri Letsididi of Lobatse High Court has dismissed with costs a case in which Notwane dragged Botswana Football Association (BFA) to court.

The be Mobile Premier League team filed an urgent application in an attempt to prevent their play-off match against FC Satmos from going ahead today (June 10). The match at Serowe Sports Complex this afternoon would determine the team that would relegate to the first division while the winner would retain the premier league status.

When presenting grounds for their case, Notwane lawyer, Tshiamo Motsumi of Mack Bahuma Attorneys said the applicant was seeking an order against a decision taken by BFA on June 5, directing the applicant (Notwane) and second respondent (FC Satmos) to participate in a playoff match to determine relegation to a lower league, pending the hearing of the complaint lodged before the premier league committee and BFA.

Notwane argued that BFA had defaulted in implementing the rules, hence their complaint.

BFA lawyer, Mike Rasetshwane from Modimo amp Associates, explained that his client called for the play-off based on Article 5.3 of play rules and regulations. The article stated that ‘in the event that a team had gained soft-points which disaantaged another team, then the two teams shall play a playoff match’.

Justice Letsididi dismissed the matter with full costs, adding that he would, next week Thursday, deliver reasons for his decision.

The play-off was necessitated by the fact that FC Satmos had been awarded soft-points from their game with Sankoyo Bush Bucks, which disaantaged Notwane.

The soft-points meant that Satmos leapfrogged into position 13 on the premier league log standings while Notwane dropped into the relegation zone.
