An employee can be dismissed for ‘not fitting in’

It has been observed that the three most common reasons for dismissing an employee are; poor performance, serious misconduct and redundancy. The courts have, however, long recognised another ground for dismissal which is incompatibility. Where the incompatibility is between an employee and their employer, the incompatibility is framed as an ‘irreconcilable breakdown of trust and confidence’.
